Reform of the tax system for patents

A draft Royal Order aims to simplify the current tax system and to align it with new provisions set out in the Economic Right Code.

On 17 July 2015, the Council of Ministers approved a draft Royal Order aiming to reform the tax system for invention patents and supplementary protection certificates. The goal is to simplify the current tax system and to align it with the new provisions set out in the Economic Right Code. 

The main lines of the reform are the following:

  • to reinforce the attractiveness of the Belgian patent system by removing certain low yield taxes
  • to encourage system user responsibility for the quality of patent applications
  • to improve the quality of the information made available to the public
  • to provide finance for the obligations on Belgium for a single patent in the form of a limited increase (10%) of the taxes for keeping patents in force.

The draft has been passed to the Council of State for its opinion.
